OBJECTION MATTERS - (understanding why a mark being objected)

In deciding any question of possible conflict between two application or between an application and a registered trade mark , there are two main factors before raising an objection under this Section 19(1)and (2). These are :

- whether the marks are identical or so nearly resemble each other as to be likely to deceive or cause confusion ; and

- whether the marks are used on the same goods or services , the same description of goods or services , or whether the goods and services are closely related.


* When comparing cases, Examiners should always consider each mark as a whole. It is clear that marks are identical if they are the same in every detail when compared side by side. The test for deciding whether the marks so nearly resemble each other are established in case of law as below:

BINA EMPAYAR ANDA SENDIRI


Saya percaya ramai anak anak muda dewasa ini amat cenderung dengan "web site programming", hosting, dan sebagainya .

Sebenarnya anda boleh memulakan perniagaan anda sendiri sekiranya anda mempunyai kebolehan dalam IT atau multimedia , langkah langkahnya seperti berikut:

1. Anda tidak perlu syarikat, kerana perniagaan boleh dilakukan atas nama perseorangan. Bila anda dah dapat good income baru kita daftarkan nama anda atas nama "perniagaan persendirian" . Kalau dah lagi maju baru kita daftar 'syarikat".

2. Cipta nama yang sesuai kerana selepas ini anda akan gunakan perniagaan anda dengan "nama" ini. Saya cadangkan , guna nama sendiri, kenapa...kalau kita lihat kenapa orang putih bangga sangat nak guna nama " dia " as a product? Contoh, Mc Donald, Kenny Rogers, etc.

So , sebagai rakyat Malaysia saya cadangkan anda guna nama sendiri, misalnya nama anda Mohd Shahrul Nizam . Anda boleh guna Shahrul Nizam, atau Shahrul atau Nizzam. Bila kita dah identify nama yang kita akan gunakan, pastikan kita ubah suaikan "font" nama tersebut supaya ia menjadi unik. Misalnya:

Kemudian kita cari nama yang sesuai yang memberitahu perkhidmatan apa yang diberi , misalnya : Networking

kalau lebih kreatif "cipta" satu logo dan letakkan berhampiran Trade Mark diatas , misalnya

Mulai sekarang akan bergerak atas nama di atas.
